Terms of Service

Rules for using InclusiVerse

These terms summarise the responsibilities, rights, and operational limits that apply when individuals and organisations access InclusiVerse.

Agreement to These Terms

These Terms of Service govern access to the InclusiVerse website, platform, and related services. By accessing the service on behalf of yourself or an organisation, you agree to comply with these terms and all applicable laws.

If you are using the platform for an employer or customer organisation, you confirm that you are authorised to accept these terms or any applicable order terms on that organisation's behalf.

Accounts and Access

Customers are responsible for account administration, assigning authorised users, maintaining the confidentiality of login credentials, and ensuring users access the service only for legitimate training, administration, or support purposes.

Users must provide accurate information, keep account details current, and notify InclusiVerse promptly if they suspect unauthorised access or misuse.

Permitted Use

The platform may be used only for lawful business, training, community, and accessibility-related purposes consistent with the service design. Users may not interfere with the platform, attempt unauthorised access, upload malicious content, or use the service in a manner that infringes rights or violates applicable law.

Customers remain responsible for the legality, accuracy, and appropriateness of any material they upload, generate, or assign through the platform.

Customer Content and Generated Materials

Customers retain ownership of content they submit to InclusiVerse. By submitting content, customers grant InclusiVerse the rights reasonably necessary to host, process, transform, display, and deliver that content as part of the service.

InclusiVerse may generate learning materials, transcripts, summaries, or analytics based on customer-provided content and user activity. Customers are responsible for reviewing generated outputs before relying on them in regulated or high-risk contexts.

Intellectual Property

InclusiVerse and its licensors retain all rights in the platform, software, user interface, branding, site content, documentation, and core service materials except where rights are expressly granted to customers under a separate agreement.

Users may not copy, reverse engineer, resell, distribute, or create derivative works from the platform except as permitted by law or authorised in writing.

Availability and Service Changes

We aim to keep the service available and secure, but the platform may be temporarily unavailable due to maintenance, updates, third-party failures, connectivity issues, or events outside our reasonable control.

InclusiVerse may update, improve, suspend, or discontinue features from time to time. Where practical, we will provide notice of material changes that affect core service use.

Compliance, Suspension, and Termination

InclusiVerse may suspend or restrict access where reasonably necessary to address security risks, legal compliance concerns, non-payment, suspected fraud, or material breaches of these terms or customer agreements.

Customers may stop using the service at any time, subject to any notice periods, fees, or commitments agreed in separate commercial terms.

Disclaimers and Liability

The service is provided on an "as is" and "as available" basis to the extent permitted by law. While we work to deliver a reliable platform, we do not guarantee uninterrupted availability or that every generated, uploaded, or reported output will be error-free.

To the extent permitted by applicable law, InclusiVerse is not liable for indirect, incidental, consequential, special, or punitive damages arising from platform use, loss of profits, loss of data, or business interruption. Nothing in these terms excludes liability that cannot be excluded by law.

Governing Law and Contact

These terms are governed by the laws of South Africa unless mandatory law requires otherwise. Questions about legal notices, commercial arrangements, or platform use can be sent to info@inclusiverse.co.za or through the contact page.

These terms provide a general site-level framework and may be supplemented by customer order forms, statements of work, or enterprise agreements where applicable.
